Bilateral Relations in the Mediterranean - Prospects for Migration Issues (Hardcover): Francesca Ippolito, Gianluca Borzoni,... Bilateral Relations in the Mediterranean - Prospects for Migration Issues (Hardcover)
Francesca Ippolito, Gianluca Borzoni, Federico Casolari
R3,874 Discovery Miles 38 740 Ships in 12 - 17 working days

This timely book assesses national and supranational bilateral approaches to dealing with the rising tide of migration into the European Union via the Mediterranean Sea. International law and EU migration law specialists critically assess the legal tools adopted to engage with the 'refugee crisis'. While the EU works to develop a unified approach to Mediterranean transit and origin countries, the authors argue that a crucial role should be accorded to individual states in finding a solution to this complex and sensitive situation. Historical and political factors playing into migration strategies are discussed, and the legal framework underpinning the bilateral and regional schemes on which the northern and southern shores of the Mediterranean seek to cooperate on migration is also examined. Migration-related issues, such as search and rescue at sea, human rights and policing are explored throughout the book. Comparing the bilateral arrangements Southern EU Member States have made with the Mediterranean countries of origin and the regional bilateralism conducted by the EU, expert authors assess how best to achieve a coherent model. This will be an essential read for academics and scholars in international and European migration law, environmental politics and policy; practitioners and policymakers working on migration issues, and NGOs. Contributors include: C. Billet, M. Borraccetti, G. Borzoni, F. Casolari, M. Di Filippo, M. Gatti, I. Gonzalez Garcia, F. Ippolito, K.D. Magliveras, A. Ott, M. Ovadek, E. Papastavridis, I. Sammut, F. The EU and the Proliferation of Integration Principles under the Lisbon Treaty (Paperback): Francesca Ippolito, Maria Eugenia... The EU and the Proliferation of Integration Principles under the Lisbon Treaty (Paperback)
Francesca Ippolito, Maria Eugenia Bartoloni, Massimo Condinanzi
R1,287 Discovery Miles 12 870 Ships in 12 - 17 working days

The entry into force of the Lisbon Treaty has brought about a proliferation of "integration principles". In addition to the environmental integration principle, which has been part of the EU legal framework for some time, the Lisbon Treaty introduced the principles of gender equality integration, social policy integration, non-discrimination integration, consumer protection integration as well as animal welfare integration. Furthermore, a general principle of integration policy objectives is contained in Article 7 TFEU, requiring that the Union must ensure consistency between its policies and activities, taking all relevant policy requirements listed under the TFEU into account in the adoption of any legislative measure. These integration principles must be pursued, or at least taken into account, when decisions are being taken in almost any area of EU policy-making. However, there is considerable uncertainty regarding the normative implications of the various integration principles as well as their legal value and practical relevance for EU policymaking. This book addresses the implications of the proliferation of sectorial integration principles and the introduction of a universal requirement of policy consistency in terms of the division of competences between the Union and the Member States as well as the scope for judicial review of the EU legislative process. In particular, it explores whether the introduction of various integration principles has led to an extension of Union competences and whether it has limited the scope for judicial review by extending the discretionary power of the Union institutions.

Francesca Ippolito; Ademola Abass
R4,318 Discovery Miles 43 180 Ships in 12 - 17 working days

This book is a comprehensive assessment of regional responses to the crisis in the asylum/refugee system and critically examines how different regions tackle the problem. The chapters consider the fundamental challenges which undermine an effective asylum process as well as regional difficulties with the various circumstances surrounding African asylum seekers. With contributions on Africa, Europe, Latin America, South Asia and the Middle East, the collection strives to appreciate what informs each region's approach to the asylum process and asks if there are issues common to every region and if regions can learn from each other. Including a discussion on the protection of asylum seekers within the African human rights system, the book seeks an understanding of what legal regime exists for the protection of refugees and how regional institutions such as human rights commissions and regional courts enforce and adjudicate the law.The book will be valuable to those interested in international law, migration and human rights.

Migration in the Mediterranean - Mechanisms of International Cooperation (Hardcover): Francesca Ippolito, Seline Trevisanut Migration in the Mediterranean - Mechanisms of International Cooperation (Hardcover)
Francesca Ippolito, Seline Trevisanut
R2,973 Discovery Miles 29 730 Ships in 12 - 17 working days

Mediterranean states have developed various cooperation mechanisms in order to cope with the issues that arise from migration. This book critically analyses how institutional actors act and interact on the international scene in the control and management of migration in the Mediterranean. It highlights how, even though the involvement of 'universal' international organisations guarantees a certain balance in setting the goals of cooperation mechanisms and buttresses a certain coherence of the actions, the protection of migrants' fundamental rights is still an objective as opposed to a reality, and security imperatives and trends still prevail in the aftermath of the 2011 Arab Spring.

Protecting Vulnerable Groups - The European Human Rights Framework (Paperback): Francesca Ippolito, Sara Iglesias Sanchez Protecting Vulnerable Groups - The European Human Rights Framework (Paperback)
Francesca Ippolito, Sara Iglesias Sanchez
R1,760 Discovery Miles 17 600 Ships in 10 - 15 working days

The concept of vulnerability has not been unequivocally interpreted either in regional or in universal international legal instruments. This book analyses the work of the EU and the Council of Europe in ascertaining a clear framework or a set of criteria suitable to determine those who should be considered vulnerable and disadvantaged. It also explores the measures required to protect their human rights. Key questions can be answered by analysing the different methods used to determine the levels of protection offered by the two European systems. These questions include whether the Convention and the case law of the Strasbourg Court, the monitoring mechanisms of the Council of Europe, EU law and the case law of the European Court of Justice enhance the protection of vulnerable groups and expand the protection of their rights, or, alternatively, whether they are mainly used to fill in relatively minor gaps or occasional lapses in national rights guarantees. The analysis also shows the extent to which these two European systems provide analogous, or indeed divergent, standards and how any such divergence might be problematic in light of the EU accession to the European Convention on Human Rights.

Francesca Ippolito
R4,281 Discovery Miles 42 810 Ships in 10 - 15 working days

This book is dedicated to a topic which has for a long time lacked the attention it deserves within the academic world. It intends to address in a coherent and comprehensive manner the problem of the environmental rights of the child, which are not identical to the ones of adults whose environmental rights have been appraised from a general point of view. In the absence of any international law instrument explicitly granting a child the right to a clean environment, drawing on an extensive and original analysis of the UN Convention on the Rights of the Child and the practice of its monitoring body, this book undertakes an assessment of the extent to which these challenges may be overcome through a greater engagement between international law on the rights of the child and international environmental law. The result is the first comprehensive study on the manner in which these two mutually reinforcing legal regimes can interact to strengthen the protection of children's environmental human rights at stake in the increased strategic environmental and climate litigations at both the national and international level. The book is recommended reading for, amongst others, policy makers, international environmental lawyers and human rights lawyers and practitioners. Additionally, lecturers, students and researchers from a range of disciplines will also gain from seeing how new legal scholarship and intertwined branches of international law contribute to the continual development of the living rights of the human rights conventions. Francesca Ippolito is Associate Professor of International Law in the Department of Political and Social Science of the University of Cagliari, Italy. She holds the Jean Monnet Chair on European Climate of Change - REACT for 2021-2024.
